In accordance with the provisions of article 23 and subsequent articles of Law 34\/2002 on information society services and electronic commerce, contracts entered into electronically shall produce all the effects provided for by the legal system, provided that the consent of both parties is given and can be accredited.<\/span><\/p>\nFor these purposes, it shall be understood that the completion of all the phases of the reservation process and, if applicable, the payment of the corresponding economic amount, necessarily implies the express consent required for the contracting of the service.<\/span><\/p>\nLikewise, and in accordance with the provisions of Article 27 of Law 34\/2002 of services of the information society and electronic commerce, it is made available to users, prior to the start of the contracting procedure all information relating to it.<\/span><\/p>\nThe contracting conditions indicated below are directly applicable to the reservations and stays made available through the web portal https:\/\/www.bensumar.com\/, unless expressly stated otherwise.<\/span><\/p>\nBOOKING AND CONTRACTING PROCEDURE<\/b><\/p>\n
Any person with Internet access can carry out the contract as long as he\/she is over 18 years of age.<\/span><\/p>\nThe phases of the procurement procedure are visible to users throughout the entire procurement process. Three phases can be distinguished:<\/span><\/p>\n\n- User identification.<\/span><\/li>\n
- Selection of the reservation and payment method.<\/span><\/li>\n
- Confirmation of reservation<\/span><\/li>\n<\/ul>\n
The user only has to select the accommodation and the dates for which he\/she wishes to book and click on the booking confirmation button provided for this purpose. This will initiate the contracting procedure, which will always follow the steps indicated above for all available services.<\/span><\/p>\nOnce the establishment, number of nights, applicable taxes, total price and payment method have been selected, the platform will show the user a summary of the contracting process, together with the applicable contracting conditions, which in any case must be expressly accepted by the user in order to continue the contracting process.<\/span><\/p>\nOnce the acceptance box of the contracting conditions has been checked, in case of having selected any electronic payment method, the user will be directly redirected to the corresponding external payment platform to make the payment, without https:\/\/www.bensumar.com\/ having the possibility to access at any time to the user’s credit card data and\/or payment systems.<\/span><\/p>\nThe security of the payment procedure is guaranteed by the financial institution.<\/span><\/p>\nOnce the contracting of the service has been completed, a summary screen of the contracting process will be displayed.<\/span><\/p>\nIn the event that payment by credit card has been selected, this will be carried out through the bank’s POS, a platform completely unrelated and independent of the provider.<\/span><\/p>\nWithin a maximum period of 24 hours, the service contracting party will receive an e-mail containing all the information related to the contracted reservation. This document is the confirmation that the contracting has been successfully completed, being valid as a means of accreditation for any type of claim, as long as the corresponding proof of payment is attached.<\/span><\/p>\nIn the confirmation email you will find the exact address of the apartment, contact details, and the rest of the instructions for arrival and departure.<\/span><\/p>\nThe provider informs the user that all bookings made will be recorded in a file for the control and management of reservations and bookings, in which will be reflected along with the information of the contracted reservation, additional information to ensure the security and evidence of the correct completion of the procedure.<\/span><\/p>\nhttps:\/\/www.bensumar.com\/ is not responsible in case of occasional failures in the continuity of the service or the lack of availability of the same.<\/span><\/p>\nIn the event that for reasons beyond our control the reservations or accommodations are not available after contracting from the time of notification of the incident, the user is entitled to request the provider to terminate this contract and refund the amounts corresponding to the services not enjoyed, which will be duly refunded through the same means that had been made the initial payment or, where appropriate, by bank transfer.<\/span><\/p>\nIn the event that any of the contents accessible through the platform were contrary to current regulations, we undertake to proceed to its immediate removal, as soon as we become aware of and corroborate the facts.<\/span><\/p>\nCANCELLATION POLICY<\/b><\/p>\n
A full refund is only possible if there are at least 30 days before the arrival date and the cancellation is made within 48 hours from the time of booking. <\/span><\/p>\n50% will be refunded when the cancellation is made at least 29 to 14 days prior to arrival and the cancellation is made within 48 hours from the time of booking. - Parties or disturbing activities on the property: 100\u20ac.<\/span><\/li>\n
- Check-out after check-out time if it does not prevent the use to the next guest: 50\u20ac for each hour or fraction thereof (unless written authorization).<\/span><\/li>\n
- Check-out after check-out time if it prevents the use of the following guest: in addition to the above, the costs of relocation of the following guest.<\/span><\/li>\n
- Missing items: Replacement value.<\/span><\/li>\n
- If the amount of the deposit does not cover the aspects mentioned in the previous points, the guest is personally responsible for covering the difference.<\/span><\/li>\n
- If there are more guests who assume responsibility for the deposit, they shall sign on the back of this sheet, indicating the same information required of the main guest, making them jointly and severally liable for the obligations arising from this document.<\/span><\/li>\n
- The deposit will be refunded on the day of check-out if paid in cash and within 7 days after check-out if another method is used.<\/span><\/li>\n
- The signing of this document implies satisfaction with the state of conservation and cleanliness of the leased property, as well as the proper functioning of all appliances and household appliances.” <\/span><\/li>\n<\/ul>\n

Use of the apartment.<\/span> By making a reservation on our website, the client and his companions agree to make proper use of the rented apartment, exempting in any case Bensumar from any liability for damages that may cause this use.<\/span><\/p>\nValuables. <\/span> Bensumar is not responsible for any valuables that the client may bring and\/or deposit in the apartment. You can purchase additional insurance or check the apartment description to see if it has a safe.<\/span><\/p>\nDamage caused<\/span>. The customer shall be responsible for any damage caused to the floor, except for normal wear and tear caused by the daily use of the floor. If you lose the keys, you must pay the costs of making copies and\/or changing the lock.<\/span><\/p>\nCHECK-IN AND CHECK-OUT<\/b><\/p>\n\n- Arrival at the apartment: From 15:00 onwards <\/span><\/li>\n

APARTMENT CLEANLINESS<\/b><\/p>\n
Each reservation includes a mandatory end-of-stay cleaning service that will be paid separately from the price. All apartments will be equipped with sheets and towels. However, the client is responsible for cleaning the apartment, removing the waste generated and returning it in a reasonably clean and tidy condition.<\/span><\/p>\nNumber of guests.<\/span> It is forbidden to accommodate more guests in the contracted apartment than the number of guests declared in the reservation (except for children under 2 years old), unless expressly authorized by Urban Hosts and upon payment of the price increase.<\/span><\/p>\nCOMPORTAMIENTO Y RESPONSABILIDADES<\/b><\/p>\n

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS<\/b><\/p>\n

The provider guarantees the user that it is the legitimate owner of the platform and that it is not involved in any type of legal dispute prior to the signing of this contract.<\/span><\/p>\nThe user expressly acknowledges that the provider holds all right, title and interest in the platform and the IT developments associated with the service, as well as in all its modules, modifications and updates and in any element and\/or functionality developed thereon, regardless of whether or not this has been requested by the user. For these purposes, it is included without limitation, the recognition of the ownership of the provider of all copyrights, intellectual property, and \/ or industrial, being able to exploit the platform, without any restriction of time, territory, media related to media or modes of exploitation and without limitations other than those established by law.<\/span><\/p>\nThe structure, characteristics, codes, working methods, information and information exchange systems, development tools, know-how, methodologies, processes, technologies or algorithms that constitute and\/or may constitute the platform are the exclusive property of the provider and are duly protected by national and international intellectual and\/or industrial property laws, and may not be subject to subsequent modification, copying, alteration, reproduction, adaptation or translation by the user, without the prior express consent of the provider.<\/span><\/p>\nLikewise, all user manuals, texts, graphic drawings, databases, which complement the platform and\/or the materials associated with it, are the property of the provider, without being subject to further modification, copying, alteration, reproduction, adaptation or translation by the user.<\/span><\/p>\nThe provision of the platform in service mode or the mere access by the user does not imply, in any case, the transfer of ownership, nor the granting of a right of use in favor of the user other than that expressed in these conditions.<\/span><\/p>\nIn order to allow the user to use the platform, which is the exclusive property of the Provider, the latter hereby grants the user a non-exclusive, non-transferable, revocable, non-sublicensable and non-sublicensable license to use the platform, which is limited in time to each connection period and unlimited in space insofar as it can be accessed from any computer with Internet access.<\/span><\/p>\nIn any case, any type of reproduction, imitation, transmission, translation, modification, elaboration of derivative works and\/or public communication is absolutely forbidden, regardless of the means used to do so, and the infringing user will otherwise assume all direct or derivative liabilities that may arise.<\/span><\/p>\nFor any aspect that is not expressly recognized in this contract, all rights are reserved in favor of the provider and the written authorization of the latter is necessary to carry it out.<\/span><\/p>\n\n- CONCERNING THE CONTENT AND INFORMATION OF THE USERS<\/b><\/li>\n<\/ol>\n
All content and information published or managed by users on the platform are the exclusive property of the platform, being https:\/\/www.bensumar.com\/ a mere provider of information society services responsible for data storage.<\/span><\/p>\nThe provider does not receive any kind of intellectual property rights for the fact that the user hosts or manages them on its platform, so in no case may they be used for purposes other than those directly related to the provision of the services actually contracted.<\/span><\/p>\nCONFIDENTIALITY AND DATA PROTECTION<\/b><\/p>\n
In accordance with the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, all personal data provided during the provision of the services will be treated in accordance with the provisions of the Privacy Policy, which every user must expressly and previously accept in order to register.<\/span><\/p>\nAll users who accept the present conditions of use, accept in an informed, express and unequivocal way our Privacy Policy, assisting them in this sense the rights of access, rectification, cancellation and opposition regarding their personal data, being able to exercise them as reported in the aforementioned Privacy Policy.<\/span><\/p>\nTEMPORARY CONDITIONS<\/b><\/p>\n
The present conditions shall come into force on the date of contracting the service.<\/span><\/p>\nECONOMIC CONDITIONS<\/b><\/p>\n
The rates applicable to each of the services offered through the platform shall be solely and exclusively those published on the online platform, and these shall be the only valid rates, except for typographical or transcription errors, in which case the provider undertakes to modify them immediately.<\/span><\/p>\nThe Provider reserves the right to cancel the contracts made from the moment of their realization in case it detects the existence of typographical or transcription errors in the price and\/or taxes applied to the transaction.<\/span><\/p>\nThe provider reserves the right to make any type of modification on the rates of each accommodation, committing itself to publish them on the platform in a visible way for the users.
